General Terms and Conditions
§ 1 - Provider, Inclusion of the GTC
(1) The provider and contractual partner for the goods displayed in the "Dream Horse" shop is:

(hereinafter referred to as "Provider").
(2) These general terms and conditions are part of every contractual agreement between the provider and the respective customer. Deviating general terms and conditions of the customer will not be recognized unless the provider expressly agrees to their validity in writing.
§ 2 - Product Offer and Conclusion of Contract
(1) The provider offers the items displayed in its "Dream Horse" shop for sale. The color representation of the items on the website may vary slightly depending on the internet browser used and the customer's monitor settings; these deviations are technically unavoidable.
(2) Selection of goods, conclusion of contract, and contract processing are conducted in German.
(3) The provider sells to customers in Germany and worldwide.
(4) The customer selects the desired goods by placing them in the "shopping cart" or by clicking the "Checkout" button. The order request can be finally submitted to the provider via the "place order with payment obligation" button. The customer has the option to view and change the data provided during the order at any time until the order request is sent or to cancel the order entirely.
(5) The provider makes a binding purchase offer for the goods displayed in the provider's shop. By sending the order request via the "place order with payment obligation" button, the customer accepts the purchase offer. The provider confirms the conclusion of the contract via email (contract confirmation).
(6) In case of delivery obstacles or other circumstances that would hinder contract fulfillment, the provider will inform the customer via email.
(7) Reduced items or communicated sale items at separately indicated prices are generally excluded from return, as they are time-limited seasonal items. The customer agrees with the purchase that acquired items cannot be returned, unless Dream Horse has additional sizes available for an exchange.
§ 3 - Prices and Payment
(1) The prices stated at the time of the order apply. All prices include the statutory value-added tax.
(3) Payment for the goods can be made according to the payment methods proposed during the ordering process under the conditions stated there. We reserve the right to exclude certain payment methods depending on the results of the verification of your data (identity and credit check).
(4) For prepayment orders, a payment period of 7 days applies from the receipt of the contract confirmation. The provider reserves the desired goods for the customer during the payment period and retains the right to ship the goods as quickly as possible for service reasons. It is the customer's responsibility to ensure that their payment is made in time to be received by the provider within the deadline. The provider reserves the right to withdraw from the purchase contract and sell the goods elsewhere if payment is not received by the end of the deadline. If the customer does not make a payment within the set deadline, this does not mean the purchase contract is definitively extinguished. The customer must submit a written withdrawal from the purchase contract within the set withdrawal period.
(5) Embroidery costs are calculated separately per order, as they depend on the individuality and size of the embroidery. Invoicing occurs upon delivery of the goods. Creation of embroidery files is charged separately and is waived for repeat orders.
§ 4 - Shipping, Delivery Times
(1) The provider delivers the goods in stock within 3-5 working days after payment is received.
(2) For products that are made according to the buyer's specifications, the delivery time is extended.
(3) Multiple products ordered simultaneously will be delivered in a single shipment; the delivery time of the product with the longest delivery time applies to the joint shipment. If the customer wishes to receive a specific product with a shorter delivery time in advance, they must order this product separately.
(4) If no copies of the product selected by the customer are available at the time of the customer's order, the provider will inform the customer of this within 48 hours after an automated order confirmation. If the product is permanently unavailable, the provider will refrain from an acceptance declaration. In this case, a contract will not be concluded.
(5) If delivery to the customer fails because the customer has provided an incorrect or incomplete delivery address, a new delivery attempt will only be made if the customer bears the immediate costs of the redelivery. These costs correspond to the shipping costs agreed upon at the conclusion of the contract.
(6) The shipping of the goods is done via postal service. The shipping risk is borne by the provider if the customer is a consumer.
§ 5 - Return of Goods as a Consumer
(1) A customer who purchases as a consumer has a right of withdrawal in accordance with the legal conditions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activities.
(2) If a consumer receives a non-personalized or not specially made product that does not meet their expectations, they can return it to us within the 14-day return right. Individually manufactured items or goods outside the stock offering are excluded from exchange. Reduced goods can only be returned for a credit note.
Promotional Items: If you received a promotional item with your order, it must also be returned with the goods being returned. Otherwise, Dream Horse is entitled to charge this in full.
§ 6 - Warranty
(1) The warranty rights of the customer are based on the statutory provisions.
§ 7 - Gift Vouchers
(1) A gift voucher can be credited to the value of goods in whole or in part. An exchange or cash payment is not possible. The gift voucher is valid for 3 years from the date of issue. No liability is accepted for loss or theft.
§ 8 - Retention of Title
(1) Until full payment is received, the delivered goods remain the property of the provider.
§ 9 - Liability
(1) Claims for damages by the customer are excluded. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract.
§ 10 - Right of Withdrawal Information
(1) Consumers generally have a statutory right of withdrawal when concluding a distance selling transaction, which the provider informs about according to the statutory model below.
§ 11 - Final Provisions
(1) The provider collects and processes the data entered by the customer during their purchase for the purpose of contract processing and fulfillment. If the customer uses the PayPal service for payment of their purchase, the PayPal privacy policy applies to the payment process. PayPal acts as the fulfillment agent of the customer, not the provider.
(2) Should individual provisions of these general terms and conditions prove to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.
